　　出来及遅刻候儀ハ不苦首之儀ハ両人附置小屋出来次第獄門ニ梟候様被申聞其段十郎右衛門
　　へ申達之右捨札之儀ハ新保村詰西之方へ建候旨出役組之者申聞候赤坂へも右捨札

一寛政二戌六月廿六日町奉行小林又右衛門幷三郡奉行へ左之通被仰出
　　於役所詮議者有之吟味相済候上御仕置方書付を以被相伺候儀ニ付軽重之無差別近来之振合ニ而死罪ニ相当り候御仕置
　　筋ニ候共御憐愍之上入墨追放可被仰付哉之旨被相伺候得共思召を以軽く可被仰付儀も可有之候其向ゟハ致吟味御定書
　　幷古来ゟ之儀格を以相当之御仕置向後被相伺候様被仰出候以上
【朱書き】此条ハ吟味詮議之部ニ可入
一同年十一月廿五日　役所取扱筋是迄入交り候ニ付別紙之通被仰出候以後左様相心得可被取扱之候　　　　町奉行　小林又右衛門
　一御家人之分於町役所御吟味被仰付候節ハ御目付出席可被仰付事
　一諸役所ゟ引渡者之儀ハ於其役所吟味有之其科証人有之候歟又ハ証拠物何レ印等有之候得共不及白状拷問被仰付候節ハ
　町役所へ引渡候上其支配頭吟味可致事ニ付其節ハ町奉行御目付立合可被仰付候事
　　但右之通吟味之上相分チ候上ハ御仕置筋支配頭ゟ可相伺事尤御差図之節斬罪以上ハ町役所へ被仰付入墨以下ハ
　　　其支配頭へ可被仰付事
　一惣而引渡者ハ於其支配吟味有之其上御不審御座候節ハ於町役所吟味被仰付候間其罪ニ寄御目付斗出席可被

　　　但右之通吟味之上相分チ候節ハ口書を以其支配へ引渡御仕置之儀ハ支配頭ゟ可相伺事
　　右之通支配下之者幷他国他領之者同様可被仰付事
一御家中召仕候男女不審之儀有之候得ハ其段申達御目付ゟ其主人へ通達有之主人ゟ役所へ指出候儀且役所ゟ連
　寄候儀ハ其主人之可為勝手次第事
一右同断召捕候程之者ハ其主人ゟ相渡候儀且主人ゟ暇差出於門前役先之者為召捕候儀ハ御目付ゟ通達之節其主人
　之了簡次第之事惣而御家中屋敷之内へ役先之者入込召捕候儀ハ有之間敷事
一過料銀闕所幷取揚物等有之節ハ都而其品町役所へ可相納事

　腰ためし申度旨申越候ニ付御家老中へ申達候処御仕置者有之刻為切可遣旨被申候
一享保十二未閏正月廿五日牢屋打首有之御徒目付組之者牢屋へ差出
一同十八丑正月廿二日御預所番田村七郎兵衛理右衛門同村安左衛門を殺候ニ付江戸表へ御仕置御伺之処死罪被仰付今日於牢
　屋死罪被仰付此節御預所御目付幷表御目付も壱人罷出候様御家老中被申聞罷出候一件委細留有之
一同廿卯二月廿五日於明里御仕置者有之御腰物も御様シニ出候ニ付御目付共之内壱人可罷出旨玄番方被申聞候
一同年十月十六日来ル十九日御仕置者被仰付候由大宮彦右衛門申聞候ニ付御腰物方へ可申遣哉と左膳方へ伺候処可申遣旨御
　様シ御道具出候ハヽ拙者共之内前々之通罷出候様左膳方被申聞候

一宝永七寅閏八月廿四日明廿五日御仕置者被仰付筈之処昨夜御城代酒井与惣兵衛死去候ニ付重キ御役儀之者之儀ニ候ヘハ三日之内ハ差除可然と各申談延引有之
一享保十三申六月廿五日斬罪之者七人被仰付　但死罪之者之儀場へ出し候ヘハ御費も有之故此節牢屋ニ而討首ニ申付候也　恕按此頃諸向厳重之御簡略有之
一寛延三午八月十五日之夜於江戸小役人格志田幾野右衛門忰源五郎御徒山口官兵衛方へ罷越口論之上及刃傷官兵衛右手疵ニ而相果候付同十八日源五郎
　巣鴨御屋敷へ被指越御仕置ニ被仰付　但官兵衛死骸ハ親万兵衛相願候ニ付被下置
一元禄八亥二月廿九日御目付西尾伝兵衛病気高田金太夫ハ評定日ニ而差合候ニ付今日御仕置場所為検使御持物頭之内雪吹喜左衛門
　罷出候様昨日以金太夫季喜左衛門ニ□□則喜左衛門罷出也

現代語訳

出来が遅刻したことは問題ないが、首の件については両人を付け置き、小屋ができ次第獄門に梟すように申し聞かせ、その段を十郎右衛門へ申し達した。右捨札の件については新保村詰西の方へ建てる旨を出役組の者が申し聞かせ、赤坂へも右捨札を指し出すように御家老が申し聞かせた事

一、寛政二戌六月二十六日町奉行小林又右衛門並びに三郡奉行へ左の通り仰せ出された
　　役所にて詮議の者がおり、吟味が済んだ上で御仕置方書付をもって伺いを立てる件につき、軽重の差別なく近来の振り合いにて死罪に相当する御仕置筋でも、御憐愍の上入墨追放を仰せ付けられるかの旨を伺い立てるが、思し召しをもって軽く仰せ付けられる件もあるだろう。その向きからは吟味を致し、御定書並びに古来からの儀格をもって相当の御仕置を向後伺い立てるように仰せ出された以上

【朱書き】この条は吟味詮議の部に入れるべし

一、同年十一月二十五日　役所取扱筋がこれまで入り交じっていたにつき、別紙の通り仰せ出された。以後そのように心得て取り扱われたい　　　　町奉行　小林又右衛門
　一、御家人の分を町役所で御吟味を仰せ付けられる節は御目付出席を仰せ付けられる事
　一、諸役所から引渡しの者の件については、その役所で吟味があり、その科証人があるか又は証拠物いずれも印等があるが白状に及ばず拷問を仰せ付けられる節は、町役所へ引き渡した上でその支配頭が吟味を致す事につき、その節は町奉行御目付立会いを仰せ付けられる事
　　但し右の通り吟味の上相分かった上は御仕置筋を支配頭から伺うべき事。もっとも御指図の節、斬罪以上は町役所へ仰せ付けられ、入墨以下はその支配頭へ仰せ付けられる事
　一、総じて引渡しの者はその支配で吟味があり、その上で御不審がある節は町役所で吟味を仰せ付けられるので、その罪によって御目付だけ出席を仰せ付けられる事
　　　但し右の通り吟味の上相分かった節は口書をもってその支配へ引き渡し、御仕置の件は支配頭から伺うべき事
　　右の通り支配下の者並びに他国他領の者も同様に仰せ付けられる事
一、御家中で召し仕う男女に不審の件があれば、その段を申し達し、御目付からその主人へ通達があり、主人から役所へ指し出す件、また役所から連れ寄せる件は、その主人の勝手次第の事
一、右同断で召し捕るほどの者は、その主人から相渡す件、また主人から暇を差し出し門前で役先の者が召し捕る件は、御目付から通達の節その主人の了簡次第の事。総じて御家中屋敷の内へ役先の者が入り込んで召し捕る事はあってはならない事
一、過料銀闕所並びに取り上げ物等がある節は、すべてその品を町役所へ納めるべき事

　　但し右過料銀闕所並びに取り上げ物等がある節は、御目付月番までその品を申し達すべき事
　　　　〆　この外町方御諸事についての事並びに出入足問屋宿屋入り方等の仰せ出しがあり略す。また郡奉行その外それぞれに仰せ渡された事

一、元禄十一寅六月五日町奉行渥美新右衛門が相達した。宍倉与兵衛殿請け込み手代渋垂助左衛門と申す者の方から、もし御仕置の者があれば脇指一腰で試したい旨申し越したにつき、御家老中へ申し達したところ、御仕置の者がある刻に切らせてやる旨を申された

一、享保十二未閏正月二十五日牢屋で打首があり、御徒目付組の者を牢屋へ差し出した

一、同十八丑正月二十二日御預所番田村七郎兵衛理右衛門が同村安左衛門を殺したにつき、江戸表へ御仕置御伺いをしたところ死罪を仰せ付けられ、今日牢屋で死罪を仰せ付けられた。この節御預所御目付並びに表御目付も一人罷り出るように御家老中が申し聞かせ罷り出た。一件委細の留めがある

一、同二十卯二月二十五日明里にて御仕置の者があり、御腰物も御様子に出たにつき、御目付共の内一人罷り出るべき旨を玄番方が申し聞かせた

一、同年十月十六日来る十九日御仕置の者を仰せ付けられる由を大宮彦右衛門が申し聞かせたにつき、御腰物方へ申し遣わすべきかと左膳方へ伺ったところ、申し遣わすべき旨、御様子御道具が出れば拙者共の内前々の通り罷り出るように左膳方が申し聞かせた

一、同年八月二十九日江戸から申し来た覚　一、御仕置の者の件で仰せ付けられる者があれば、町奉行大宮彦右衛門へ申し聞かせ、科書を相認め重ねて指し越すべき旨仰せ出され、また御仕置の者を仰せ付けられる月日も仰せ出される由にて書付が来る　覚　一、正五九月　一、七月　一、御年忌月　一、公儀御精進日
　一、御家御忌日　一、悪日　右の外御忌月向後は御構いなし　卯七月　右悪日とあるのは友引の日の事の由、追って申し来る【ここまで朱書き】

一、宝永七寅閏八月二十四日明二十五日御仕置の者を仰せ付けられる筈のところ、昨夜御城代酒井与惣兵衛が死去したにつき、重き御役儀の者の件なので三日の内は差し除くのが然るべきと各々申し談じ延引があった

一、享保十三申六月二十五日斬罪の者七人を仰せ付けられた　但し死罪の者の件を場へ出せば御費用もあるゆえ、この節牢屋にて討首に申し付けた　恕按この頃諸向厳重の御簡略があった

一、寛延三午八月十五日の夜、江戸にて小役人格志田幾野右衛門の息子源五郎が御徒山口官兵衛方へ罷り越し口論の上刃傷に及び、官兵衛が右手の疵にて相果てたにつき、同十八日源五郎を巣鴨御屋敷へ指し越し御仕置に仰せ付けられた　但し官兵衛の死骸は親万兵衛が相願ったにつき下げ置かれた

一、元禄八亥二月二十九日御目付西尾伝兵衛が病気、高田金太夫は評定日にて差し合ったにつき、今日御仕置場所の検使として御持物頭の内雪吹喜左衛門が罷り出るように、昨日金太夫により喜左衛門に□□、則ち喜左衛門が罷り出た
