現代語訳

一、すべて立ち戻った者の再度の処分については、罪の軽重により死罪・入墨および国外追放より軽い処分は申し付けないこと。国外追放の場合は右に同じ。 一、追放された者の赦免については、平生より十分に吟味し、これまでの前例よりも厚く配慮すべきこと。 一、他国他領の無宿者が立ち戻った場合は、罪の軽重に関わらず死罪を申し付けること。 一、斬罪・磔などの大罪については、いずれも伺いを立てること。 右の通り以後心得て取り扱うよう、それぞれに申し渡したので、そのように心得るべきこと。 一、文化二年丑年閏八月、町在(町方・在方)の刑事処分について、従来より申し渡しがあったが、近頃混乱の様子もあるため、家老中の評議の上で改正があり、左の通り書付を支配頭々へ渡され、村田十太夫が伝達し、荒川十右衛門へは飛脚で伝達された。 町在刑事処分者のこと 一、押込・過料・手鎖・逼塞・蟄居・他参留・牢舎 一、城下追放 一、城下および居村・三里・五里・七里・十里四方追放 右は支配頭が伺いを立てた際に問題がなければ、一席評議までで即刻伺いの通り申し渡すこと。 ただし問題がある場合、または町在ともに身元の良い家柄の者等については、目付らまたは事案により奉行らとも評議に及ぶことがあること。 一、国内にて十三里四方追放 右は目付らとも評議の上、お上に達して取り扱うこと。 一、入墨追放 右同じ。 一、死罪・獄門・火罪・磔 右同じ。 立ち戻り者の刑事処分のこと 一、城下追放より七里四方追放の者は、再度国中の追放を伺う際、問題がなければ一席評議までで即刻伺いの通り申し渡すこと。 一、十里四方追放の者は、国内十三里四方追放を伺う際、一度追放の者であるから問題がなければ一席評議までで即刻伺いの通り申し渡すこと。 一、国外追放者が入墨追放を伺う際、問題がなければ前条と同じ。 一、入墨追放者の立ち戻りについては死罪相当のこと。 一、軽い罪で度々立ち戻り、ついに国外追放となった者で、非常に愚かな者またはば病気等で立ち戻り乞食の様子で回り、他に悪事のない者は格別に評議の上、入墨を用捨して再度国外追放を申し付けることもあること。 一、軽い追放者が重病に及んだ際、親類らその町その村の役人らが赦免を願い出た場合、支配頭が吟味の上で伝達すれば、赦免を即刻取り扱うこと。もちろん快復すれば再度追放とし、病死すればその節に伝達し、また目付らへ報告しておくよう申し聞かせること。

For those banished from castle town to 7 ri radius who are subject to renewed banishment within the domain, if there are no complications when making inquiry, decisions may be rendered immediately through single-seat deliberation as requested. 1. For those banished to 10 ri radius, when inquiring about banishment to 13 ri radius within the domain, since they are already once-banished persons, if there are no complications, decisions may be rendered immediately through single-seat deliberation as requested. 1. When inquiring about tattooing and banishment for those banished from the domain, if there are no complications, same as the previous clause. 1. The return of those subjected to tattooing and banishment warrants the death penalty. 1. For those who repeatedly returned for minor offenses and finally received domain banishment, if they are extremely foolish persons or have returned due to illness and wander about as beggars with no other wrongdoing, after special deliberation, tattooing may be waived and domain banishment may be imposed again. 1. When those with light banishment become seriously ill and their relatives and village or town officials petition for pardon, if the administrative head investigates and reports, pardon shall be handled immediately.
