 違ニ候而此度表向ゟ被仰出候御命奉畏候へハ其分ニ而相済候事故若又  間違之筋も可有之哉と内々承合度得御意候段申入之所 委細致承知候  役人共致吟味見可申候暫可扣之旨也此内御花壇奉行当番三宅大炊  被相招被尋様子也尤西池縫殿直弟当番ニ而挨拶ニ被出也追付三河守  被出被申聞ハ役人共致吟味候処成程百姓共申候通十八日ゟ廿五日迄八日之間ハ  御願申拝領被仰付候左候ヘハ彼等ハ其通申候筈ニ候何共不相済事ニ候と気のとく成  顔付ニ候へとも伝奏へ伺之義先差扣可申候とも又御窺候へとも不被申候とかく此分ニ而ハ  不済義と計被申候故此方ゟ申入ハ左候へハ乍気毒不得止事是ゟ罷出候而  御伺可申上候将又此間町口美濃守殿へ得貴意候通御用水御下地之義ハ是迄  谷様方ゟ社中迄被仰下其上社中ゟ致支配候古格ニ御座候此間之通ニ  小山百姓共ゟ彼是申越候而ハ古格も難相立候間小山樋内之義ハ格別  樋ゟ外川筋之義ハ御用水不依多少社中へ被仰下候様ニ御取計奉頼候  則是迄御取次中ゟ一社へ被仰下候書付共入御覧候段申入西池三郎右衛門  木坂和泉守佐原織部正西池出雲守藤木志摩守栂井石見守  飯室越前守等ゟ之口上書四通見せ候処三河守被申候此義ハ不及一覧  心得居候由申候へ共致持参候事故先御一覧可被下候旨申入本紙ハ見せ候迄ニ而  取帰り新写を残し置帰り也夫ゟ御奉行弁殿へ参上申入候処水谷木工被  出候ニ付一通り右之次第を申上口上窺書を差出候処被致一覧可申上□先中宿へ  退居可申旨也依之中宿檜物師方ニ休息亥ノ刻比石井主水水谷木工ゟ連名  之書状到来罷出候様ニとの仰也 即刻参上之処水谷木工被出被仰出候ハ窺書先  御落手被遊候小山郷之義ハ尚御吟味可被遊との義也尤今日窺書之外ニ女房  御奉書之写伝奏ゟ之御添翰写享保十二年五月小山郷百姓ゟ一社中迄  願出社中ゟ万里小路弁殿へ願上候社記之抜書取次中ゟ之下地状等入御覧候  之所不残差返しニ而窺書と此度小山百姓共ゟ差出候口上書計御留メ  置也此趣御伝奏葉室中納言殿へ御届申上九ツ半時帰郷也  窺書之留       謹而奉窺口状  当時渇水ニ付賀茂御神領植付難相成候故御池御用水拝領之儀奉願候処以先格  早速拝領被為 仰付難有畏入候然ル処右御用水拝領仕候上神領之所々  配分仕申合随分無由断田地植付候様申渡候処小山郷中之百姓一社中へ罷出申届候ハ  御池御用水之御儀小山郷百姓清兵衛久左衛門と申者両人ゟ御所御役人中様へ御願  申上則蒙御免去ル十八日ゟ来ル廿五日迄私共へ拝領仕置候間此度御社中ゟ  之被仰渡之儀ハ難致承知段申出候此儀ハ往古ゟ小山百姓共ゟ一社中迄  相願候而従一社中御願申上拝領仕先格ニ御座候然ル所彼百姓共先格ニ違ひ  御所御役人中江直ニ相願不埒之致方仕候ニ付此度も右之仕合ニ御座候尤小山郷  百姓共ゟ願上候儀於一社中ハ不奉存以古格社中江拝領仕候御儀御座候

現代語訳

違いでしたら、この度表向きから仰せ出された御命を畏まって承りましたら、その分で済む事故、もしまた間違いの筋もありましょうかと内々承り合いたく、御意を得たい段を申し入れた所、委細承知いたしました。役人共に吟味させて見ましょう。しばらくお控えください、との事でした。この間に御花壇奉行当番の三宅大炊が招かれてお尋ねになった様子です。もっとも西池縫殿の直弟が当番にて挨拶に出られました。追って三河守が出られて申し聞かせるには、役人共に吟味させました所、なるほど百姓共が申す通り十八日から二十五日まで八日の間は御願い申して拝領を仰せ付けられました。そうしましたら彼等はその通り申すはずです。何とも済まない事です、と気の毒そうな顔付きでしたが、伝奏への伺いの義はまず差し控えるべきですとも、またお窺いくださいとも申されませんでした。とかくこの分では済まない義だとばかり申されました故、こちらから申し入れるには、そうでしたら気の毒ながらやむを得ない事、これより罷り出て御伺い申し上げましょう。また、この間町口美濃守殿へ貴意を得た通り、御用水御下地の義はこれまで谷様方から社中まで仰せ下され、その上社中から支配いたす古格にございます。この間の通りに小山百姓共から彼是申し越しては古格も立ち難く候間、小山樋内の義は格別、樋から外の川筋の義は御用水の多少に依らず社中へ仰せ下されるよう御取り計らい頼み奉ります、と申し入れました。すなわちこれまで御取次中から一社へ仰せ下された書付共をご覧に入れます段を申し入れ、西池三郎右衛門、木坂和泉守、佐原織部正、西池出雲守、藤木志摩守、栂井石見守、飯室越前守等からの口上書四通を見せた所、三河守が申されるには、この義は一覧に及びません、心得ております、と申されましたが、持参いたしました事故、まずご一覧くださいと申し入れ、本紙は見せるだけにて取り帰り、新写を残し置いて帰りました。それから御奉行弁殿へ参上申し入れた所、水谷木工が出られましたので、一通り右の次第を申し上げ、口上窺書を差し出した所、一覧いたして申し上げましょう、まず中宿へ 退居申すべし、との事でした。これにより中宿檜物師方に休息、亥の刻頃石井主水、水谷木工からの連名の書状が到来、罷り出るようにとの仰せでした。即刻参上した所、水谷木工が出られて仰せ出されるには、窺書はまずお落手遊ばされました。小山郷の義はなお御吟味遊ばすべきとの義です。もっとも今日窺書の外に女房御奉書の写し、伝奏からの御添翰写し、享保十二年五月小山郷百姓から一社中まで願い出で、社中から万里小路弁殿へ願い上げた社記の抜書、取次中からの下地状等をご覧に入れた所、残らず差し返しにて、窺書とこの度小山百姓共から差し出した口上書だけ御留め置きです。この趣を御伝奏葉室中納言殿へお届け申し上げ、九つ半時に帰郷しました。 窺書の留め       謹んで窺い奉る口状 当時渇水につき賀茂御神領の植え付けが相成り難く候故、御池御用水拝領の儀をお願い申し上げた所、先格をもって早速拝領を仰せ付けられ、有り難く畏れ入り候。然る所右御用水拝領仕りました上、神領の所々に配分仕り申し合わせ、随分理由なく田地植え付け候よう申し渡した所、小山郷中の百姓が一社中へ罷り出で申し届けるには、御池御用水の御儀、小山郷百姓清兵衛、久左衛門と申す者両人から御所御役人中様へ御願い申し上げ、すなわち御免を蒙り、去る十八日から来る二十五日まで私共へ拝領仕り置き候間、この度御社中からの仰せ渡しの儀は承知いたし難い段申し出で候。この儀は往古から小山百姓共から一社中まで相願いして、一社中から御願い申し上げ拝領仕る先格にございます。然る所彼の百姓共先格に違い、御所御役人中へ直に相願い不埒の致し方仕り候につき、この度も右の仕合いにございます。もっとも小山郷百姓共から願い上げた儀、一社中においては存じ奉らず、古格をもって社中へ拝領仕る御儀にございます。

During this time, it appears that Miyake Ōi, the duty officer for the Imperial Garden Administration, was summoned for questioning. Indeed, Nishiike Nuinodono's direct subordinate came out as the duty officer to give greetings. Subsequently, Mikawa-no-kami appeared and explained: "We had our officials investigate, and indeed, as the farmers stated, from the 18th to the 25th, for eight days, they petitioned and were granted the allocation. So they would naturally say what they did. This is indeed a troublesome matter." Though he looked apologetic, he neither said we should refrain from consulting the densō nor that we should proceed with the consultation. He only said that this matter could not be resolved as it stood. Therefore, we responded: "If that is the case, though we regret it, we have no choice but to proceed and submit our inquiry." We also stated: "As we obtained your esteemed opinion from Lord Machiguchi Mino-no-kami the other day, regarding the imperial water allocation, according to ancient precedent, orders have been issued from the Tani family to the shrine administration, and the shrine administration has exercised authority over it. With the Koyama farmers making various demands as they have recently, it becomes difficult to maintain the ancient precedent. While the matter of the Koyama aqueduct is exceptional, regarding the river systems outside the aqueduct, we request that you arrange for imperial water to be allocated to the shrine administration regardless of the amount." We then presented for review the documents that had been issued from the intermediary officials to the shrine. When we showed four written statements from Nishiike Saburōemon, Kizaka Izumi-no-kami, Sahara Oribe-shō, Nishiike Izumo-no-kami, Fujiki Shima-no-kami, Togai Iwami-no-kami, and Iimuro Echizen-no-kami, Mikawa-no-kami said: "This matter requires no review; I am already aware of it." However, since we had brought them, he said he would first take a look. We showed the original documents, then took them back and left copies before returning. Then we went to visit Lord Magistrate Ben, where Mizutani Mokku received us. We explained the entire situation and submitted a written inquiry. He said he would review it and report, and that we should first withdraw to our lodging. Accordingly, we rested at the woodworker's place in our lodging. Around the hour of the Boar, a joint letter arrived from Ishii Mondo and Mizutani Mokku, commanding us to appear. We immediately went, where Mizutani Mokku appeared and announced: "Your written inquiry has been received. Regarding the matter of Koyama Village, further investigation will be conducted." Additionally, today, besides the written inquiry, we presented for review copies of the court ladies' documents, copies of accompanying letters from the densō, petitions from Koyama Village farmers to the shrine administration from Kyōhō 12, 5th month, petitions from the shrine administration to Lord Manrikōji Ben, extracts from shrine records, and authorization documents from the intermediary officials. All were returned without exception, with only the written inquiry and the statement submitted by the Koyama farmers this time being retained. This matter was reported to His Excellency Densō Hamuro Chūnagon, and we returned home at 9:30. Copy of the Written Inquiry       Respectfully Submitted Statement of Inquiry Due to the current drought, planting in Kamo Imperial Shrine Territory has become difficult, so we petitioned for allocation of water from the imperial pond. Based on precedent, the allocation was quickly granted, for which we are deeply grateful and honored. However, after receiving this imperial water allocation, we distributed it to various locations in the shrine territory and gave strict instructions for planting without any exceptions. Then farmers from Koyama Village came to the shrine administration and reported: "Regarding the imperial pond water allocation, two Koyama Village farmers named Seibei and Kyūzaemon petitioned the palace officials directly and received permission. They have already received their allocation from the 18th of last month to the 25th of this month, so they cannot comply with the shrine administration's current directive." This matter has, since ancient times, been handled according to precedent whereby Koyama farmers would petition the shrine administration, and the shrine administration would then petition and receive the allocation. However, these farmers violated precedent by petitioning the palace officials directly, which was improper conduct, and the same situation has occurred this time. Moreover, regarding the petition submitted by the Koyama Village farmers, the shrine administration was not informed, though by ancient precedent, the allocation should be received by the shrine administration.
