  味事候受取渡相済相対ハ構無之事  一子共又ハ兄弟ニ而も自分ニ御奉公相勤候者別部屋建置同性屋敷替之節引取申度旨   断有之候時ハ其段御家老中へ相達得指図相渡可申候尤別分部や建候節屋敷奉行迄   断有候時ハ覚書ニ留置可申事    但隠居ニ而も兄弟ニ而も無足之者ハ部屋建置候而も取申事難成定ニ候乍去浪人    之親類願申上屋敷之内ニ別宅建住居候者其部屋建候砌屋敷奉行へ断留  書有之分ハ屋敷替候節御家老中へ相達為取可申候縦自分ニ御奉公相勤候    者ニ而も都度本家ニ建続取候跡本家損候歟勿論本家之内ニ而部屋有之分ハ渡不申筈ニ候尤右之部屋取候跡ハ能為繕請取可申事  一長屋之分敷物不残相渡可申候其外板敷立具石板踏段二階之階子窓戸障子天   井裏板等も少もて手附不申其侭可為差置候惣而長屋へ附置候庇之分ハ一切為取申   間敷事  一本家長屋土蔵共ニ一ト間々々ニ有物委細書付可為致張紙候事右張紙之通為致帳面帳   之奥書右帳面之通相改差上申者也と書付名之下ニ為致印形可申候受取之主方へ   直ニ改相渡帳之奥ニ右帳面之通相改無相違慥ニ受取申候也と書付判形取可申候帳ハ屋   敷奉行方ニ取置可申事  一御役屋敷入替之節ハ畳敷物其侭指置互ニ入替り可申候植木ハ前々ゟ在来候外   自分ニ植申分丈ゟ内之木ハ断有候者可相渡候其外法之通相改請取渡可仕事  一自分願ニ而相対之屋敷替ハ願之通相叶申断を承届屋敷帳ニ名を附替申迄ニ而入替之   時分ハ先規之通構申ニ不致【及】候事  一新地ニ而屋敷被下候節御茶薗地と名付荒子頭仮預り之地ハ割渡申候砌屋敷奉行中組   之者召連罷越奉行代小算之者も罷出歩数相改渡可申候但御定歩数之外見分次   第免悪水地三人通リ割渡筈境之次ハ一方ツヽ支配有之筈ニ候御高之内百姓地ニ而相   渡候節ハ御代官検地奉行も下代共召連罷出何も立合割渡可申事   一跡目無之揚り屋敷有之節家屋敷請取申儀も定法之通致可申事  一御暇被下明屋敷ハ目付中ゟ断有之次第早速組之者両人ツヽ指遣置門前ニ附置候而浮 道具之外敷物竹木庭石立具類出し不申様ニ断申浮道具不残取払候節受   取之組之者指遣能々吟味為仕相違無之候ハヽ一ト間〳〵為致張紙尤植木庭石等迄   委細書付可申候但草花之類ハ不及書付候張紙之通帳面ニ写帳奥書右帳面之通相改無   相違慥指上申者也と書付候本人親類之内為致判形可申候其節不及申屋敷奉行罷   越見分可仕候事其跡組御持筒足軽番人付尤番人も慥ニ預り申候と書付判形取   可申候其後御奉行中へ相達御作事方ゟ町大工○   壱人受取候而両組ゟ立合為致指図候而月番之御家老中迄可            指出候其節屋敷願之順帳も写一所ニ 【朱書】ソ

現代語訳

吟味すること。受け取り渡しが相済めば、相対については構わないこと  一、子供または兄弟でも自分でご奉公を勤める者が別部屋を建て置き、同姓の屋敷替えの節に引き取りたい旨の届け出があった時は、その段をご家老中へ相達し、指図を得て相渡すべきである。もっとも別分の部屋を建てる節、屋敷奉行まで届け出があった時は覚書に留め置くべきこと    但し、隠居でも兄弟でも無足の者は部屋を建て置いても取ることは難しい定めである。しかしながら浪人の親類が願い出て屋敷の内に別宅を建て住居する者で、その部屋を建てた砌に屋敷奉行へ届け出の留め書きがある分は、屋敷替えの節にご家老中へ相達して取るべきである。たとえ自分でご奉公を勤める者であっても、都度本家に建て続けて取った跡で本家が損じることは勿論、本家の内で部屋がある分は渡さない筈である。もっとも右の部屋を取った跡は、よく繕いを為して請け取るべきこと  一、長屋の分は敷物を残らず相渡すべきである。その外、板敷、建具、石板、踏み段、二階の階子、窓戸、障子、天井裏板等も少しも手を付けず、そのまま差し置くべきである。総じて長屋へ付け置いた庇の分は一切取ってはならないこと  一、本家、長屋、土蔵共に一間々々にある物を委細に書き付けて張り紙を致すべきこと。右張り紙の通りに帳面を致し、帳の奥書に「右帳面の通り相改めて差し上げ申す者なり」と書き付け、名の下に印形を為すべきである。受け取りの主方へ直に改めて相渡し、帳の奥に「右帳面の通り相改め、相違なく確かに受け取り申し候なり」と書き付けて判形を取るべきである。帳は屋敷奉行方に取り置くべきこと  一、ご役屋敷入れ替えの節は、畳敷物をそのまま指し置き、互いに入れ替わるべきである。植木は前々より在来の外、自分で植え申した分だけより内の木は、届け出のある者に相渡すべきである。その外は法の通り相改めて請け取り渡しを仕るべきこと  一、自分の願いで相対の屋敷替えは、願いの通り相叶え申すとの届けを承り、屋敷帳に名を付け替え申すまでで、入れ替えの時分は先規の通り構え申すに及ばないこと  一、新地で屋敷を下される節、お茶園地と名付けた荒子頭仮預りの地は、割り渡し申す砌に屋敷奉行中の組の者を召し連れて罷り越し、奉行代、小算の者も罷り出て歩数を相改めて渡すべきである。但しお定めの歩数の外、見分次第で免、悪水地、三人通りを割り渡す筈で、境の次は一方ずつ支配がある筈である。お高の内、百姓地で相渡す節はお代官、検地奉行も下代共を召し連れて罷り出て、何も立ち合って割り渡すべきこと  一、跡目なしの上がり屋敷がある節、家屋敷を請け取り申す儀も定法の通り致すべきこと  一、お暇を下されて明け屋敷は、目付中より届け出がある次第、早速組の者両人ずつ指し遣わして門前に付け置き、浮き道具の外、敷物、竹木、庭石、建具類を出さないよう断り申す。浮き道具を残らず取り払う節、受け取りの組の者を指し遣わし、よくよく吟味を為し、相違なければ一間々々張り紙を致し、もっとも植木庭石等まで委細に書き付けるべきである。但し草花の類は書き付けに及ばない。張り紙の通り帳面に写し、帳の奥書に「右帳面の通り相改め、相違なく確かに指し上げ申す者なり」と書き付け、本人親類の内で判形を為すべきである。その節、申すに及ばず屋敷奉行が罷り越して見分を仕るべきこと。その跡、組のお持ち筒足軽を番人に付け、もっとも番人も「確かに預かり申し候」と書き付けて判形を取るべきである。その後、お奉行中へ相達し、お作事方より町大工○一人を受け取って両組より立ち合いを致して指図し、月番のご家老中まで指し出すべきである。その節、屋敷願いの順帳も写しを一所に 【朱書】ソ

When children or brothers who serve independently in official service have built separate rooms and request to take them when the same family name undergoes residence transfer, this matter shall be reported to the Senior Councilors and handed over according to their instructions. When separate rooms are built, if there is notification to the residence magistrate, it should be recorded in a memorandum.    However, it is established that retired persons or brothers without stipends cannot easily remove rooms they have built. Nevertheless, when ronin relatives petition to build separate residences within the estate grounds, if there are written notifications to the residence magistrate when such rooms were built, they may be removed upon residence transfer after reporting to the Senior Councilors. Even if someone serves independently in official service, if removal would damage the main house after repeated additions, and naturally for rooms within the main house, these shall not be transferred. After removing such rooms, they must be properly repaired before handover.  1. For row houses, all floor coverings must be transferred. Additionally, wooden flooring, fixtures, stone slabs, steps, upstairs staircases, window doors, sliding screens, ceiling back boards, etc., must not be touched at all and left as they are. Generally, eaves attached to row houses must never be removed.  1. For main houses, row houses, and storehouses alike, items in each room must be recorded in detail and posted. An inventory should be made according to these postings, with a colophon stating "This inventory has been inspected and submitted," signed and sealed below the name. For direct inspection and transfer to the receiving party, write in the ledger's conclusion "This inventory has been inspected without discrepancy and certainly received," and obtain a seal. The ledger shall be kept by the residence magistrate.  1. When exchanging official residences, tatami and floor coverings should be left in place for mutual exchange. Regarding plants, except for those existing from before, trees planted personally may be transferred to those who notify. Other matters should be inspected and transferred according to regulations.  1. For private residence exchanges requested personally, after receiving notification that the request is granted and changing names in the residence ledger, there is no need to follow previous regulations during the exchange period.  1. When granting residences in new districts, land temporarily managed by village headmen and designated as tea garden land shall be allocated with residence magistrates bringing group members, with magistrate representatives and accountants also present to inspect and transfer the measured area. However, beyond the standard measurements, depending on inspection, tax-exempt and waterlogged land, and three-person pathways shall be allocated, with boundaries having jurisdiction on each side. When transferring peasant land within the assessed area, district magistrates and land survey officials should bring subordinates and jointly oversee the allocation.  1. When there are vacant residences without heirs, taking possession of house and grounds should also follow established regulations.  1. For vacated residences after dismissal, immediately upon notification from inspectors, two group members each shall be dispatched to guard the gate, preventing removal of floor coverings, bamboo and wood, garden stones, fixtures, etc., except for movable equipment.
