   屋敷替ニ付諸事 一侍中屋敷替被仰付又は屋敷主跡潰候時其屋敷ニ親類縁者別ニ御奉公相勤罷在自  分部屋を建罷在右部屋引取願候儀ハ只今迄願書付指出候而も此以後ハ其訳屋敷奉行  迄相達屋敷奉行吟味之上各々申達先例之通無子細候ハヽ為引取候様屋敷奉行へ可申聞  事右之外浪人等は右屋敷之内ニ部屋建罷在候儀ニ候ハヽ是又同前之事   但本家へ指掛候抔仕別之部屋之道理ニ無之ハ其節屋敷奉行吟味次第可替事     簡事【?】 一屋敷替被仰付候跡ハ御家老中相伺屋敷奉行へ其段可申達候事 一屋敷替被仰付候節鉄御門内ゟ通抜古畳其外見苦物運行申儀ハ往来之妨ニも相  成へく候間遠慮可然旨其主人へ可相達儀之由 但川口御門三之丸通り抜ハ月番目付中へ以     手紙断申筈 一寛政十二申八月多賀谷権兵衛俵町ニ有之候下屋敷と寺町ニ有之候青山次郎右衛門元地面  と相対振替候願之事 一屋敷替之節御法も有之候間屋敷奉行へ承合互ニ無相違入替り候様ニ被仰出最初屋敷改  之定之条ニ出之可見合 屋敷坪数之条も可見合 一文化八未十二月屋敷相対替願書面之内引替申度と申文言以後相認不申様御番頭初へ  御目付月番致通達候事 一屋敷替之節物置部や之類相対を以譲受申度旨双方ゟ口上書を以相達候得ハ御家老中へ相伺致勝手  次第候様指差図有之候得ハ其段双方并屋敷奉行へ申達候筈 弘化三午十月廿六日仙石万右衛門波々伯部熊蔵如此 【朱書】ラ

現代語訳

屋敷替えに関する諸事項 一、侍中の屋敷替えを仰せ付けられ、または屋敷主の跡が絶えた時、その屋敷に親類縁者で別に御奉公を勤めて居住しており、自分の部屋を建てて居住している者が、右の部屋の引き取りを願い出る件については、今まで願書付を提出していたが、今後はその理由を屋敷奉行まで連絡し、屋敷奉行が検討の上、各々へ申し達し、先例通り問題がなければ引き取らせるよう屋敷奉行へ申し聞かせること。右の他、浪人等がその屋敷の内に部屋を建てて居住している場合も、これまた同様のこと。  ただし本家へ関わる等で、別の部屋の道理にない場合は、その節屋敷奉行の検討次第で変更すべきこと。     簡事【?】 一、屋敷替えを仰せ付けられた跡は、家老中に伺いを立て、屋敷奉行へその旨を申し達すべきこと。 一、屋敷替えを仰せ付けられた節、鉄御門内から通り抜けで古畳その他見苦しい物を運搬することは、往来の妨げにもなるであろうから、遠慮するのが然るべき旨をその主人へ相達すべきこと。ただし川口御門三之丸通り抜けは月番目付中へ手紙で断りを申すはず。 一、寛政十二申年(1800年)八月、多賀谷権兵衛の俵町にある下屋敷と、寺町にある青山次郎右衛門の元地面との相対による振り替えの願いの件。 一、屋敷替えの節は御法もあるので、屋敷奉行へ問い合わせ、互いに相違なく入れ替わるよう仰せ出された。最初の屋敷改めの定めの条項を参照すべき。屋敷坪数の条項も参照すべき。 一、文化八未年(1811年)十二月、屋敷相対替えの願書面の内、「引替申度」という文言を今後は認めないよう、御番頭をはじめへ御目付月番が通達したこと。 一、屋敷替えの節、物置小屋の類を相対をもって譲り受けたい旨、双方から口上書をもって連絡があれば、家老中へ伺いを立て、勝手次第とするよう指図があれば、その旨を双方並びに屋敷奉行へ申し達すはず。弘化三午年(1846年)十月二十六日、仙石万右衛門、波々伯部熊蔵このように。 【朱書】ラ

Various Matters Concerning Estate Transfers 1. When samurai are ordered to transfer estates, or when the estate owner's lineage ends, if relatives or connections who serve separately in official duties reside on that estate and have built their own quarters, regarding their petitions to take over those quarters: while petition documents have been submitted until now, hereafter the circumstances should be communicated to the estate magistrate, and after the estate magistrate's examination and communication to each party, if there are no issues according to precedent, the estate magistrate should be informed to allow the takeover. The same applies to masterless samurai (rōnin) who have built quarters within such estates.  However, if there are connections to the main family and it does not follow the logic of separate quarters, changes may be made at the estate magistrate's discretion at that time. In the 8th month of Kansei 12, year of the monkey (1800), regarding the petition for mutual exchange between Tagaya Gonbē's lower estate in Tawara-chō and the former land of Aoyama Jirōemon in Tera-chō. 1.
