  右之外ハ前々之通ニ候 【朱書】此条ハ別紙也夫ニ而両通ニ成也且又此条ハ前之口達之覚ノ頭ニ有之筈 一 御改易御暇等被下候者之親類目付中へ自身相達指図之上早速彼者宅へ罷越相仕廻候   而続之品ニより遠慮之儀御家老中迄夫々取次を以相伺可然事   八百里言右之条とも御咎之部所々ニ雖出之連続之儘尚又爰ニ出之 【朱書】同三寅十二月十三日左之趣御伺之上相極候段御家老中御用留之内ニ有之写朱書之通 一延享四卯正月狛帯刀方被相渡候御書付左之通 〇一切腹被仰付者有之其親類縁者遠慮【之節】父子兄弟伯父甥聟舅迄遠慮【可】申渡【候】事 〇一閉門并御呵之節父子之儀ハ遠慮相伺候ハヽ遠慮申渡置其段可達御耳【訂正聴】事     但兄弟以下不及遠慮乍然【訂正併】兄弟之内御近習相勤候ハヽ【訂正者】相伺可申渡其外之親類ハ御近習た     りと言とも不及遠慮即刻可申渡事 【朱書】○右之通御式目ニ有之ニ付右之趣ニ准シ御咎軽ク遠慮不被仰付其身伺候而遠慮仕者有之其親類縁者遠慮伺候へハ父子之儀ハ先      差控罷在候様ニ申渡      置其段達御耳      御咎之品ニ寄時々思召を以取扱候事又御呵之上      遠慮仕様ニ被仰付者之親類共遠慮伺ニ而も      閉門とハ違遠慮も被仰付者親類共遠慮伺ハ      大概遠慮ハ不申渡候其中父子兄弟之内ハ其      品ニ寄或ハ差控とか相慎候へとか即刻申聞置達      御耳是又思召を以取扱候事 〇一御暇被下候者親兄弟遠慮相伺候節遠慮申渡達御耳追而可申聞【候】事    但伯父甥従弟【等】并縁者【ハ】伺候而も不及遠慮旨可申渡候事 ○一親御暇被下候得ハ忰別ニ御奉公相勤者御暇被下候事    但他家へ罷越候者ハ無御構 无 右式目之通 无一親御暇被下者之父子兄弟他家へ罷越候者之儀ハ御暇ハ不被下遠慮可申付事 无一遠慮之者親類縁者遠慮伺候節父子之儀ハ差控候様被申聞他家へ罷越候者ハ不及其儀段被   申聞候事縦令他名を継候共父子一所ニ罷在候者ハ指控候様ニ可被申聞事    但御近習ニ相勤者ハ縦令一所ニ不在共父子兄弟之儀ハ指控罷在候様被申渡其段可被達     御耳事其余之親類ハ御式目之通不及指控之旨可被申渡事    右之通御近習之儀ハ御目通可致遠慮旨ニ付如此之取扱ニ候へハ御在江戸御留守之節ハ他家    へ罷越候父子兄弟不及差控旨可被申渡候事 无一上ゟ被仰付候遠慮又ハ下ゟ相伺候而も遠慮被申渡節ハ同事之取扱候事 无一指控罷在候様ニ申渡儀ハ上ゟ被仰付候而も相伺候とも同事之取扱之事此節ハ門をも打不   申通路人等ニ及不申事 〇一遠慮之者方へ通路之儀ハ急度御式目ニハ無之候前々取扱候趣を以身近者相願候へハ【壱人】致通路候   様【ニ】申渡尤目付中へ可相断旨申聞候指控候様ニ申渡者ハ門をも打不申候ニ付通路之儀無之候【由】 【朱書き】〇〆印之通也為見合書入置    八百里言右九ケ条之趣御咎之部所々ニ雖出之連続之儘尚又爰ニ出之 一侍中遠慮被仰付尤其品ニハ寄候得共日数過分ニ長ク御免之御沙汰も御評議無之節ハ此方ゟ御家老中  へ相伺申儀も有之也   但右様之節ハ評定所ニ而ハ不宜御用番御宅ニ而相伺可然事 一於評定所閉門遠慮等不依何事御家老中退出後御取扱有之相済罷帰候節ハ月番之者直  ニ御用番へ罷出相達候事 【左上朱書き】ク

右の外は前々の通りである 【朱書】この条は別紙である。それで両通になる。且つまたこの条は前の口達の覚えの頭にあるはずである 一、御改易・御暇等を下される者の親類は目付中へ自身申し達し、指図の上で早速その者の宅へ参り処理を済ませ、続きの品により遠慮の件を御家老中まで、それぞれ取次を以て相談するのがよろしいこと 八百里言:右の条共はお咎めの部の所々に出ているが、連続のまま、なお又ここに出す 【朱書】同三年寅十二月十三日、左の趣旨を御伺いの上で決定した段が御家老中御用留の内にある。写しを朱書の通り 一、延享四年卯正月、狛帯刀方に渡された御書付は左の通り ○一、切腹を申し付けられる者がある時、その親類縁者の遠慮【の節】は、父子兄弟・伯父甥・聟舅まで遠慮を【】申し渡す【べき】事 ○一、閉門並びに御呵の節、父子の件は遠慮を相談すれば遠慮を申し渡しておき、その段をお耳に【聞こえるよう】達すべき事 ただし兄弟以下は遠慮に及ばない。しかし【併せて】兄弟の内で御近習を勤めている【者が】いれば相談すべきことを申し渡し、その外の親類は御近習であっても遠慮に及ばず、即刻申し渡すべき事 【朱書】○右の通り御式目にあるため、右の趣旨に準じ、お咎めが軽く遠慮を申し付けられず、その身が伺って遠慮する者がある時、その親類縁者が遠慮を伺えば、父子の件はまず差し控えて罷り在るように申し渡しておき、その段をお耳に達す。お咎めの品により時々思し召しを以て取り扱う事。また御呵の上で遠慮するように申し付けられる者の親類共の遠慮伺いでも、閉門とは違い、遠慮も申し付けられる者の親類共の遠慮伺いは、大概遠慮は申し渡さない。その中で父子兄弟の内は、その品により、或いは差し控えとか相慎むべしとか、即刻申し聞かせておき、お耳に達す。これまた思し召しを以て取り扱う事 ○一、御暇を下される者の親兄弟が遠慮を相談する節は、遠慮を申し渡してお耳に達し、追って申し聞かせる【べき】事 ただし伯父甥従弟【等】並びに縁者【は】伺っても遠慮に及ばない旨を申し渡すべき事 ○一、親が御暇を下されれば、息子で別にお奉公を勤める者にも御暇を下す事 ただし他家へ参っている者は御構い無し 无 右は式目の通り 无一、親が御暇を下される者の父子兄弟で他家へ参っている者の件は、御暇は下されず遠慮を申し付けるべき事 无一、遠慮の者の親類縁者が遠慮を伺う節、父子の件は差し控えるよう申し聞かせ、他家へ参っている者はその件に及ばない段を申し聞かせる事。たとえ他の名を継いでも父子一緒に罷り在る者は指し控えるように申し聞かせるべき事 ただし御近習に勤める者は、たとえ一緒に居なくても父子兄弟の件は指し控えて罷り在るよう申し渡し、その段をお耳に達すべき事。その余の親類は御式目の通り指し控えるに及ばない旨を申し渡すべき事 右の通り、御近習の件はお目通りをするべき遠慮の旨につき、このような取り扱いであれば、御在江戸・御留守の節は、他家へ参っている父子兄弟は差し控えるに及ばない旨を申し渡すべき事 无一、上から申し付けられる遠慮、又は下から相談しても遠慮を申し渡される節は、同じ取り扱いをする事 无一、指し控えて罷り在るように申し渡す件は、上から申し付けられても相談しても同じ取り扱いの事。この節は門をも閉ざさず、通路人等にも及ばない事 ○一、遠慮の者の方への通路の件は、厳格に御式目には無いが、前々の取り扱いの趣旨を以て、身近な者が願えば【一人】通路をするように申し渡し、もっとも目付中へ届け出るべき旨を申し聞かせる。指し控えるように申し渡される者は門をも閉ざさないため、通路の件は無い【由】 【朱書き】○印の通りである。見合わせのため書き入れ置く 八百里言:右九ケ条の趣旨はお咎めの部の所々に出ているが、連続のまま、なお又ここに出す 一、侍中に遠慮を申し付けられ、もっともその品にもよるが、日数が過分に長く、御免の御沙汰も御評議が無い節は、こちらから御家老中へ相談申し上げることもある ただし右様の節は評定所では宜しくなく、御用番の御宅で相談するのがよろしい事 一、評定所において閉門・遠慮等、何事によらず御家老中退出後にお取り扱いがあり、済んで帰る節は、月番の者が直ちに御用番へ参り出て申し達する事

Aside from the above, everything follows previous procedures. [Red notation] This provision is a separate document. This makes two documents. Moreover, this provision should be at the beginning of the previous memorandum of oral instructions. 1. Relatives of those who receive dismissal from service (kaiekae) or dismissal (hima) should report personally to the metsuke, and upon receiving instructions, should promptly visit that person's residence to handle matters. Depending on subsequent circumstances, matters of self-restraint should be consulted with the Senior Councilors through appropriate intermediaries. Happyakuri's note: The above provisions appear in various sections of the punishment provisions, but following the original sequence, they are presented here again. [Red notation] On December 13th of the third year of Kan'en (1750), year of the tiger, the following matter was decided upon consultation, as recorded in the Senior Councilors' official records, copied as shown in red notation. 1. In the first month of Enkyō 4 (1747), year of the rabbit, the written directive given to Koma Taitō was as follows: ○1. When someone is ordered to commit seppuku, regarding the self-restraint of their relatives and in-laws [at such times], self-restraint should be ordered for fathers and sons, brothers, uncles and nephews, sons-in-law and fathers-in-law. ○1. For house confinement and reprimands, regarding fathers and sons, if they consult about self-restraint, self-restraint should be ordered and this matter should be reported to His Lordship's attention. However, brothers and those of lower relation need not observe self-restraint. Nevertheless, if among the brothers there are those who serve as close attendants (kinshū), this should be consulted and communicated. Other relatives, even if they are close attendants, need not observe self-restraint, and this should be communicated immediately. [Red notation] ○As this is stated in the formal regulations, following this precedent, when punishments are light and self-restraint is not ordered but individuals voluntarily observe self-restraint after consultation, if their relatives request self-restraint consultation, fathers and sons should first be told to refrain and wait, and this should be reported to His Lordship's attention. Depending on the nature of the offense, handling is done according to His Lordship's discretion. Also, for relatives of those ordered to observe self-restraint after reprimands, unlike house confinement, for relatives of those also ordered self-restraint, generally self-restraint is not ordered. Among these, for fathers and sons and brothers, depending on the circumstances, they may be told to "refrain" or "exercise caution," communicated immediately and reported to His Lordship's attention. This too is handled according to His Lordship's discretion. ○1. When parents and brothers of those granted dismissal consult about self-restraint, self-restraint should be ordered, reported to His Lordship's attention, and communicated subsequently. However, uncles, nephews, cousins, and in-laws need not observe self-restraint even if they request consultation, and this should be communicated. ○1. When a parent is granted dismissal, sons who serve separately should also be granted dismissal. However, those who have gone to other houses are not affected. 无 As per the above regulations 无1. For fathers and sons and brothers of those whose parents are granted dismissal, if they have gone to other houses, they should not be granted dismissal but should be ordered self-restraint. 无1. When relatives and in-laws of those under self-restraint request self-restraint consultation, fathers and sons should be told to refrain, and those who have gone to other houses are told this does not apply to them. Even if they have inherited another name, those who remain together as father and son should be told to refrain. However, those who serve as close attendants, even if not residing together, should be ordered that fathers and sons and brothers refrain and wait, and this should be reported to His Lordship's attention. Other relatives, as per the formal regulations, should be told they need not refrain. As stated above, since close attendants are subject to self-restraint from audience with His Lordship, with such handling, when His Lordship is in Edo or absent, fathers and sons and brothers who have gone to other houses should be told they need not refrain. 无1. Self-restraint ordered from above or self-restraint ordered after consultation from below should be handled the same way. 无1. Orders to refrain and wait, whether ordered from above or after consultation, should be handled the same way. In this case, gates are not closed and this does not apply to messengers. ○1. Regarding access to those under self-restraint, while not strictly stated in the formal regulations, following previous handling practices, when close associates make requests, one person should be allowed access, and it should be communicated that this must be reported to the metsuke. Happyakuri's note: The intent of the above nine provisions appears in various sections of the punishment provisions, but following the original sequence, they are presented here again. 1. When samurai are ordered self-restraint, depending on the nature of the case, if the duration becomes excessively long and there is no discussion of pardon, there are cases where consultation is made from this side to the Senior Councilors. However, in such cases, it is not appropriate to do this at the council hall (hyōjōsho) but rather should be consulted at the residence of the duty councilor (goyōban). 1. At the council hall, for house confinement, self-restraint, and all other matters, when business is concluded after the Senior Councilors' departure and one returns, the monthly duty officer should immediately visit the duty councilor and report.
