一面々家来不届之趣有之成敗仕候ハヽ前方御家老中へ相伺申筈家来御国追放
仕度者有之節も御家老中へ相伺候事都而組之者追放候取扱と同断
一享保二酉江戸ニ而大関新五左衛門家来磯助与申者不届有之ニ付御家老中へ相

家来成敗手討並びに追放 附御咎め
一、各々の家来に不届きの趣があり成敗をする場合は、事前に御家老中へ相談申すべき筈。家来を御国追放したい者がある節も御家老中へ相談すること。すべて組の者を追放する取り扱いと同様とする。
一、享保二年酉年、江戸にて大関新五左衛門の家来磯助という者に不届きがあったため、御家老中へ相談し御屋敷追放を申し付けた。もっとも組の者二人を遠見に派遣する。《割書:同十一年午年四月五日、芦田右衛門方の元中間市右衛門という者の追放の事は後に出る》
一、享保十五年戌年五月、江戸において大御番組河野一郎左衛門の若党中村次郎右衛門という者(御国松本西御堂町の者である)。この者に不届きの儀があったため御門払いにしたい由、願書・口上書をもって大御番頭菅沼与一郎が取り次ぎ相談し、願いの通り申し渡した。
一、宝暦三年酉年十月、酒井外記方の家来大久保官右衛門を追放したいと御用番へ御目付をもって御用番へ申し達した上、追放を申し付けた。
一、同十一年巳年十月、酒井外記方の家来広部清右衛門という者について下屋敷において成敗があり、右の取り扱い記録がある。
一、元禄十三年辰年四月二十二日、江戸にて八隅寿伯の家来藤助という者に不届きの儀があり、当二十二日夜、右の藤助を呼び出し寿伯が叱ったところ、藤助が口答えをして手向かったため手討ちにした由。右の趣を寿伯が高田金右太夫方へ行き申し達したため、その趣を書付にして仲間をもって御家老中へ申し達すようにと指図したため、田代養元をもって御家老中へ申し達した。
右について御家老中へ相談して御徒目付永田作兵衛並びに組の者を申し付け検使を差し越し相改めた。江戸詰御目付は三寺久左衛門・高田金太夫である。

Punishment, Execution, and Banishment of Retainers With Disciplinary Actions
1. When retainers commit misconduct and require punishment, one must first consult with the senior councilors. When there are retainers to be banished from the domain, one must also consult with the senior councilors. All procedures should follow the same handling as when banishing group members.
1. Hōkyō 2 (1717), Year of the Rooster: In Edo, Ōseki Shingo-zaemon's retainer Isosuke committed misconduct, so after consulting with the senior councilors, he was ordered expelled from the residence. 1. Same 11th year (1761), Year of the Snake, 10th month: Regarding Hirobe Seiuemon, retainer of Sakai Geki, punishment took place at the lower residence, and records of this handling exist.
1. Genroku 13 (1700), Year of the Dragon, 4th month, 22nd day: In Edo, Yasumi Juhaku's retainer Tōsuke committed misconduct. On the night of the 22nd, when Juhaku called out Tōsuke and scolded him, Tōsuke talked back and resisted, so he was struck down. Juhaku went to Takada Kinudayū's residence to report this matter. Instructions were given to write up the details and report to the senior councilors through colleagues, so this was reported to the senior councilors through Tashiro Yōgen.
Regarding this matter, after consulting with the senior councilors, Foot Inspector Nagata Sakubē and group members were appointed to send investigators to examine the case. The Edo-stationed inspectors were Mitera Kyūzaemon and Takada Kindayū.

Hōei 5 (1708), Year of the Rat, 1st day of 6th month: Tajima Tōshichi's retainer, who was habitually misconduct-prone, committed particularly outrageous acts during the evening meal after 5 o'clock on the night of the last day of the 5th month, so he was struck down.
