　扱候ニ如申聞候ニ付於此方も遂吟味候処右之趣ニ相違ハ無之候得共筑後方ニハ其節家老職且
　御用番中之儀ニも候得ハ別格ニ而可有之尚又同役致評議狛木工方へ相伺旧例書付入披見候
　処御家老中御評議之上以来右宝暦年中酒井外記取扱之通ニ御家老中へ相伺候上可申付筈
　ニ被申聞候仍之此度之儀も内分内記方へ及懸合伺之上被申付候手続ニ取計候事夫ニ付口上控左之通
　　　拙者家来岩井市之助与申者不届之儀有之御国立退申付度候間宜御取計被下度候以上

　之御国之内立退申付候仍之御届以使者申達筈ニ候得共直ニ相達候旨荻野鍋八郎御用　
　席へ罷出候節与三左衛門方被申聞尚又被申聞候ハ御国追放ニ候得ハ急度届候事ニ覚候得共御国
　立退之事ニ候間届ニ及申間敷哉猶届有之筈ニも候ハヽ其趣ニ取計呉候様被申聞候ニ付同役
　令評議候処何レ届可有之筋ニ付其趣ニ取扱追而先月御用番松平主馬方へ右之趣申達之
一天保六未十二月御家中家来御咎被仰付候節押込迄之軽キ御咎ハ其主人遠慮相伺ニ
　不及尤斬罪御追放等重キ御咎之節ハ御式目之通遠慮伺差出候筈之旨御家老中ゟ
　御内御右筆青木与一右衛門を以被申聞候仍之以来問合有之節ハ伺ニ不及旨可及返答事
　　但右ハ十一月廿九日毛受伝三郎家来酒井■右衛門押込被仰付候節伝三郎伺之儀横田作太夫

　掛り荻野鍋八郎へ申達候ニ付御触有之間も無候処家来申付方不参届儀ニ付助七遠慮伺指出候
　事尤右中間ハ助七ゟ押込申付候事
　　但此以後ハ主人伺ニ不及旨同廿三日相極ル
一弘化二巳五月廿日杉田五郎兵衛家来共名代始中小姓長屋内不慎之趣相聞候ニ付過半押込被仰
　付仍之五郎兵衛恐入遠慮伺差出候処不及其儀旨被仰出候

現代語訳

後刻、給人森源蔵という者が参り、これは文化十年酉年五月六日に本多筑後の家来立ち退きを申し付けた例をもって取り扱ったと申し聞けたため、こちらでも吟味したところ、右の趣に相違はないが、筑後方はその節家老職かつ御用番中の儀でもあったので別格であろう。なお同役で評議し狛木工方へ相談して旧例書付を披見したところ、御家老中の御評議の上、以来右の宝暦年中酒井外記取り扱いの通りに御家老中へ相談の上申し付けるはずと申し聞けられた。よってこの度の儀も内分で内記方へ懸け合い、相談の上申し付ける手続きで取り計らった。それについて口上控えは左の通り。
　私の家来岩井市之助という者に不届きの儀があり、御国立ち退きを申し付けたいので、よろしくお取り計らい下さい。以上
以来右の通り心得るべきこと。
○表へ入れるべし

一 天保二年卯年十二月二十二日、酒井与三左衛門方《この節御用番》の譜代の家来加藤万平という者に不届きの儀があり、御国の内立ち退きを申し付けた。よって御届けを使者をもって申し達すはずだが、直に相達する旨、荻野鍋八郎が御用席へ参った節、与三左衛門方が申し聞け、なお申し聞けたのは、御国追放であれば必ず届ける事と覚えるが、御国立ち退きの事なので届けに及ばないのではないか、なお届けがあるはずならその趣で取り計らってほしいと申し聞けたため、同役で評議したところ、いずれ届けがあるべき筋なのでその趣で取り扱い、追って先月御用番松平主馬方へ右の趣を申し達した。

一 天保六年未年十二月、御家中家来に御咎めを仰せ付けられる節、押込までの軽い御咎めはその主人の遠慮伺いに及ばず、もっとも斬罪・御追放等重い御咎めの節は御式目の通り遠慮伺いを差し出すはずの旨、御家老中から御内の御右筆青木与一右衛門をもって申し聞けられた。よって以来問い合わせがある節は伺いに及ばない旨返答すべきこと。
　ただし右は十一月二十九日毛受伝三郎の家来酒井■右衛門に押込を仰せ付けられた節、伝三郎の伺いの儀を横田作太夫へ内談があったため御家老中へ相談したところ、以来右の通り心得るよう申し聞けられた事。

一 天保十二年丑年八月二十日、小栗助七の中間喜八という者が浄水へ屋根芥を大量に流し、回り組の者が見つけて上水掛り荻野鍋八郎へ申し達したため、御触れがあった間もないところ、家来への申し付け方が行き届かない儀について助七が遠慮伺いを差し出した。もっとも右の中間は助七から押込を申し付けられた事。
　ただしこれ以後は主人の伺いに及ばない旨、同二十三日に決定した。

一 弘化二年巳年五月二十日、杉田五郎兵衛の家来共が名代始め中小姓長屋内で不慎の趣が聞こえたため、過半に押込を仰せ付けられた。よって五郎兵衛が恐れ入って遠慮伺いを差し出したところ、その儀に及ばない旨仰せ出された。

一 弘化三年午年六月十一日、酒井外記方から左の通り月番山本源左衛門へ届けがあった。

　私の中間開発村磯内という者に不届きの儀があったため、暇を差し出し御城下並びに居村を追放したいので、よろしくお取り計らい下さい。以上　六月　　酒井外記
右の趣を源左衛門が御用番に相達したところ、伺いの通りお取り計らい下さるよう狛帯刀方が申し聞けたため、その段を外記方へ相達した。その節外記方から郡奉行千本藤左衛門へ取り扱いの儀を届けたため、即日取り扱った旨を藤左衛門から同役月番へ相達した。もっとも外記方へも郡奉行から相達した由。ただし文政十三年寅年三月十八日狛木工方の中間今助追放の例あり。

一 享和二年戌年十一月七日、上月久右衛門の家来久助、加賀次郎右衛門の家来以蔵という者が江戸表において不都合な趣が聞こえたため、押込に差し置くよう御家老中が申し聞け、その段を両人へ手紙をもって申し達した。ただし十日目に御免で手紙を申し遣わした。

Later, the stipend recipient Mori Genzō came and reported that this case was handled following the precedent of the dismissal of Honda Chikugo's retainer on the 6th day of the 5th month of Bunka 10 (1813), Year of the Rooster. When we investigated this matter, there was no discrepancy with the stated facts, but since Chikugo held the position of senior councilor and was also serving in an official capacity at that time, this was a special case. We further consulted with our colleagues and inquired with Koma Mokku, examining precedent documents. The senior councilors deliberated and stated that henceforth, following the precedent of Sakai Geki's case during the Hōreki era, such matters should be handled after consultation with the senior councilors. Therefore, in this case as well, we privately consulted with Lord Naiki and handled the matter through proper consultation procedures. The oral statement record is as follows:
　My retainer Iwai Ichinosuke has committed misconduct, and I wish to order him to leave the domain. Please handle this appropriately. End.
This procedure should be followed henceforth.

1. Tenpō 2 (1831), Year of the Rabbit, 12th month, 22nd day: Sakai Yosazaemon's {{This time serving as duty officer}} hereditary retainer Katō Manpei committed misconduct and was ordered to leave the domain. Accordingly, this should have been reported through a messenger, but when Ogino Nabehachirō attended the official session, Yosazaemon's side stated they would report directly. They further inquired whether, since this was domain banishment, it definitely required reporting, but since it was domain departure rather than banishment, perhaps reporting was unnecessary. If reporting was still required, they requested appropriate handling. After consultation among colleagues, it was determined that reporting was indeed necessary, so it was handled accordingly, and the matter was later communicated to the previous month's duty officer Matsudaira Shume.

1. Tenpō 6 (1835), Year of the Sheep, 12th month: Regarding punishments imposed on domain retainers' servants, for light punishments up to house arrest, the master need not submit a petition of self-restraint. However, for severe punishments such as execution or banishment, a petition of self-restraint should be submitted according to regulations. This was communicated by the senior councilors through the inner secretary Aoki Yoichiemon. Henceforth, when inquiries are made, the response should be that no petition is necessary.
　Note: This was decided when Mouke Denzaburō's retainer Sakai ■emon was sentenced to house arrest on the 29th day of the 11th month. When Denzaburō consulted privately with Yokota Sakutayū about submitting a petition, the matter was referred to the senior councilors, who instructed that this procedure should be followed henceforth.

1. Tenpō 12 (1841), Year of the Ox, 8th month, 20th day: Oguri Sukeshichi's servant Kihachi discharged a large amount of roof debris into the clean water. When the patrol group discovered this and reported it to the water supply official Ogino Nabehachirō, a notice had just been issued, but since the instruction to the servant was inadequate, Sukeshichi submitted a petition of self-restraint. The servant was sentenced to house arrest by Sukeshichi.
　Note: From this point forward, it was decided on the 23rd day of the same month that the master need not submit petitions.

1. Kōka 2 (1845), Year of the Snake, 5th month, 20th day: There were reports of misconduct among Sugita Gorobyōe's retainers, including representatives and pages in the attendant quarters. Most were sentenced to house arrest. Accordingly, Gorobyōe fearfully submitted a petition of self-restraint, but was told this was unnecessary.

1. Kōka 3 (1846), Year of the Horse, 6th month, 11th day: Sakai Geki submitted the following report to monthly duty officer Yamamoto Genzaemon:

　My servant Isonai from Kaihatsu Village has committed misconduct, so I wish to dismiss him and banish him from the castle town and his home village. Please handle this appropriately. End.　6th month　　Sakai Geki
When Genzaemon communicated this to the duty officer, Koma Taitō's office responded that it should be handled as requested, so this was communicated to Geki. At that time, Geki reported the handling to district magistrate Senbon Tōzaemon, who immediately handled the matter and communicated this to his colleague on monthly duty. The district magistrate also communicated with Geki's side. Note: There is a precedent from Bunsei 13 (1830), Year of the Tiger, 3rd month, 18th day, regarding the banishment of Koma Mokku's servant Imasuke.

1. Kyōwa 2 (1802), Year of the Dog, 11th month, 7th day: Reports were heard of improper conduct in Edo by Kōzuki Kyūemon's retainer Kyūsuke and Kaga Jirōemon's retainer Izō. The senior councilors ordered them to be placed under house arrest, and this was communicated to both men by letter. Note: They were pardoned on the 10th day and this was communicated by letter.
