貴殿御所持之酒屋我等借受酒造仕
候ニ諸事取極メ之事左之通
一酒株壱本但し九百石造酒造道具不残車
屋壱ヶ所并ニ家附之諸道具等迄別紙之通相添
一家賃之義当七月より亥七月迄金拾八両毎年
右之定ニ而盆前ニ急度差上可申候尤暮ニ
御入用之節ハ半金位ハ壱割之利足附ニ而盆前
迄御貸可申候又其は諸代品物代ニ而茂御取替
御座候ハヽ右家賃之内ニ而差引相渡可申候御契
約仕置候事
一御伝馬壱軒役并屋根替諸道具破損等ハ
私方ニ而可仕候大破損之義ハ御手伝可被下候譬ハ
普請其外建修復等之類は貴殿方ニ而
可被成候事
一造酒御運上金壱歩宛私方ニ而御上納可仕
候事
屋地代水車運上之儀ハ貴殿方ニ而御差出
可被成候御契約致置候事
一酒屋御入用ニ而御断御座候而茂其年より
五ヶ年之間ハ明渡不申候商売柄俄ニ相止〆
申候而者掛方取集メ迷惑仕候ニ付右之
御契約仕置候私方ゟ相止メ候節ハ前年ニ

**誓約証文一札之事**
貴殿がお持ちの酒屋を当方が借り受け、酒造業を営むにあたり、諸事の取り決めは以下の通りとする。
一、酒株一本（ただし九百石造り）、酒造道具一式、車屋一箇所、ならびに家に附属する諸道具等に至るまで、別紙の通りに添付する。
一、家賃については、今年七月より亥年七月まで、毎年金十八両と定め、盆前に必ずお納めする。なお、暮れにご入用の際は、半金程度は一割の利息を付けて盆前までお貸しすることとする。また、その他諸々の代金・品物代などでお立替えがある場合は、右の家賃の中で差し引いてお渡しすることとする。以上の通り、お約束申し上げる。
一、御伝馬一軒役ならびに屋根の葺き替え・諸道具の破損等は当方にて行う。大きな破損の際はお手伝いをお願いする。例えば、建物の普請その他修復等の類は、貴殿の方でお行いいただくこととする。
一、酒造の運上金は一分ずつ当方よりご上納申し上げる。
屋地代・水車の運上については貴殿の方よりお支払いいただくこととする。以上の通りお約束する。
一、酒屋がご入用になりご返却の申し出があっても、その年より五ヶ年の間は明け渡さない。商売柄、急に商売を止めると、掛売りの回収等に支障をきたすため、右の通りお約束する。当方から商売を止める場合は、前年中にご通知申し上げる。家賃その他諸々のことについて、この先いかなる事情が生じましても、右の取り決めの通りいささかも増減いたさないこととする。
以上の各条の趣旨を取り決めた上は、今後いかなる事情が生じましても、少しも違背いたさないことを証するため、証文をもってこの通り申し上げる。

**A Sworn Written Agreement**
Regarding the borrowing of the sake brewery in your possession for the purpose of conducting sake brewing operations, the various terms and conditions are agreed upon as follows:
Item 1: One sake brewing license (for a production volume of 900 *koku*), all brewing equipment, one waterwheel building, and all fixtures and tools attached to the property, as detailed in the accompanying separate document.
Item 2: Regarding rent, from this July through July of the Year of the Boar, the annual sum shall be fixed at eighteen *ryō* in gold, to be paid without fail before the Bon festival each year. Moreover, should you be in need of funds at year's end, we will lend up to approximately half of that amount at an interest rate of one-tenth (*ichiwari*), to be repaid before the following Bon festival. Furthermore, if there are any outstanding payments for goods or other items that you have advanced on our behalf, these shall be deducted from the aforementioned rent and settled accordingly. This is hereby mutually agreed upon.
Item 3: The costs of the *godenma* household levy, roof replacement, and repair of various equipment shall be borne by our side. In the event of major structural damage, we ask for your assistance. For example, construction work, renovation, and other building repairs shall be carried out at your expense.
Item 4: The *unjo* (licensing tax) on sake brewing shall be paid to the authorities by our side, one *bu* at a time.
Regarding the land rent and the waterwheel tax, these shall be paid by your side. This is hereby mutually agreed upon.
Item 5: Even if you should request the return of the brewery because you require it for your own use, we shall not vacate the premises for five years from that year. Given the nature of the business, an abrupt cessation would cause difficulties in collecting outstanding accounts receivable; therefore, this condition is agreed upon as stated. Should we on our side decide to cease operations, we shall notify you the year prior. Regarding rent and all other matters, no matter what circumstances may arise hereafter, there shall be no increase or decrease from the terms set out above.
Having established the terms of each of the above articles, we hereby declare that no matter what circumstances may arise in the future, we shall not deviate in the slightest from these terms. As proof thereof, we provide this written document accordingly.
