【右丁】 【蔵書印】 根岸信輔氏寄贈 帝国図書館 昭和九年六月二十七日寄贈 ※武蔵国大里郡冑山の豪農、根岸信輔氏と二男・武香氏の蔵書を昭和九年(1934年)、遺族らが上野の帝国図書館に寄贈した際の寄贈印 【左丁】 【蔵書印】 帝国図書館 紀伊国富安庄の雑掌・経清と地頭代・頼行との 所務(荘園管理)に関する条々の相論について 右、六波羅が執り進めた去々年(正和五年〔1316年〕)閏十月二十五日の両者連署による和与状(示談書)によれば、 一、年貢未進の件について 雑掌(経清)は、年貢の未納分が米六百余石・銭六百余貫に上ると訴えた。これに対し地頭(頼行)は、当庄において毎年内検を行っているが、地頭名については適切な時期に(年貢を)納めることができず、すでに得た分をもって弁済してきた。康元元年(1256年)の御下知(幕府命令)以来、当年に至るまで積み重なった年貢の過上分(超過未納分)は米三千余石・銭二千余貫に上ると陳述した。 (これらの争点を裁定するにあたり、)所務(荘園管理)についても年貢についても、互いに煩わしい問題があることから、今後は当庄を永代にわたって地頭請所(地頭が一定額を納める請負制)とし、損失の有無を問わず、毎年五十貫をもって京都(荘園領主方)へ弁済すべきこと。これ以上については、庄務(荘園管理業務)の一切を地頭が一円(全面的)に取り仕切り、預所(管理代官)は庄務に干渉してはならないこと。 一、庄務一御代(将軍一代)に一度の検注(土地調査)の件について 雑掌(経清)は詳細を申し述べたが、検注については先例がないため、この訴訟は取り止めるものとする。 以上の前二条については、和与状(示談書)を守り、互いに

[Left folio] [Library seal] Imperial Library Matters of dispute concerning the management (shomu) of Tomiyas-no-shō in Kii Province, between the estate manager (zassho) Tsunekiyo and the deputy land steward (jitō-dai) Yoriyuki Regarding the above: According to the mutual agreement (wayo-jō) jointly signed by both parties on the 25th day of the intercalary 10th month of Shōwa 5 (1316), submitted by Rokuhara: Article 1: Concerning arrears of annual tribute (nengu) The estate manager (Tsunekiyo) filed a complaint stating that the outstanding annual tribute amounted to over 600 koku of rice and over 600 kan of cash. In response, the land steward (Yoriyuki) stated that while annual inspections (naiken) were conducted in the estate each year, payments from the land steward's named holdings (jitō-myō) could not be made at the proper time, and repayments were made only from what had already been obtained. He further stated that the accumulated arrears from the year of the shogunal order (gechijō) of Kōgen 1 (1256) up to the present year amounted to over 3,000 koku of rice and over 2,000 kan of cash. (In adjudicating these disputes,) since there are complications concerning both estate management and annual tribute, henceforth the estate shall permanently be converted to a jitō-ukesho (a system in which the land steward assumes management responsibilities in exchange for a fixed payment), and regardless of whether there is profit or loss, the land steward shall remit 50 kan per year to Kyoto (the estate proprietor's side). Beyond this, all estate management (shōmu) shall be handled exclusively by the land steward, and the estate superintendent (azukaridokoro) shall not interfere in estate affairs. Article 2: Concerning land surveys (kenchu) to be conducted once per shogunal reign Although the estate manager (Tsunekiyo) submitted detailed arguments, since there is no precedent for such surveys, this lawsuit is hereby dismissed.
