乍恐口上書を以奉願候御事
一今度建福寺御訴訟申上候山林門前
地形之分古来由緒御座候寺故
信玄公様勝頼公様御朱印御頂戴
被致候ゟ以来保科肥後守様御拝領
地之内迄代々御墨付等頂戴無相違
右之通御付被遊殊ニ御菩提所として
右之地形ニ相添候笠源村ニ而百石之地形
御付被遊候然所ニ肥後守様御国替候而
鳥居主膳正様御拝領被遊御家老
鳥山和泉殿長坂因幡殿御指図を以
建福寺を押つふし主膳正様御菩提所
峯山寺ニ可被成与理不尽ニ被仰付候住持
勿論旦那共ニ古来ゟ之由緒証文申
立候得共御聞届無御座候故住持致迷惑
江戸江罷下り御訴訟申上候得は無相違
右之通ニ子ノ年ゟ寅ノ年迄御構無御座
山林門前地形共ニ以前之通ニ支配仕候
然所ニ三年目ニ右之和泉殿因幡殿山林
門前地形御取上被成候ニ付住持旦那共々
扨如此ニ候てハ寺つふれ申候間已前之通
御付被下候得与様々御訴訟申上候得共
不相叶終ニ御返シ不被下何共迷惑仕候

恐れながら口上書をもって願い奉ります件
一、今度建福寺が訴訟申し上げました山林門前の土地の件、古来より由緒のございます寺でございますので、信玄公様・勝頼公様の御朱印をいただいておりました。それ以来、保科肥後守様の拝領地の内まで、代々御墨付などをいただき、相違なく右の通り御付与いただき、特に御菩提所として、右の土地に添えて笠源村において百石の土地を御付与いただきました。
ところが肥後守様が御国替えとなり、鳥居主膳正様が拝領されました。御家老の鳥山和泉殿・長坂因幡殿の指図により、建福寺を押しつぶし、主膳正様の御菩提所である峯山寺にするようにと理不尽に仰せ付けられました。
住持はもちろん檀那ともに古来からの由緒証文を申し立てましたが、お聞き届けいただけませんでした。そのため住持は困り果て、江戸へ下り訴訟を申し上げましたところ、相違なく右の通り、子の年から寅の年まで御構いなく、山林・門前の土地ともに以前の通りに支配いたしました。
ところが三年目に、右の和泉殿・因幡殿が山林・門前の土地をお取り上げになりました。そのため住持・檀那ともども、「このようでは寺がつぶれてしまいますので、以前の通りお付与ください」と様々に訴訟を申し上げましたが、叶わず、ついにお返しいただけず、まことに困っております。

Regarding the mountain forest and temple grounds that Kenpuku-ji has filed a lawsuit about this time - since this is a temple with ancient historical origins, we received vermillion seals from Lord Shingen and Lord Katsuyori. Since that time, even within the territory granted to Lord Hoshina Higo-no-kami, we have received official documents generation after generation without fail, and have been granted the aforementioned lands. Particularly as a family temple, in addition to the aforementioned lands, we were granted 100 koku of land in Kasagenmura village.
However, when Lord Higo-no-kami was transferred to another domain, Lord Torii Shuzen-no-sho received the grant. Under the direction of the senior retainers Toriyama Izumi-dono and Nagasaka Inaba-dono, we were unreasonably ordered to demolish Kenpuku-ji and make it into Minesan-ji, which was to be Lord Shuzen-no-sho's family temple.
The head priest and parishioners naturally presented documentary evidence of ancient historical claims, but were not granted a hearing. Therefore, the head priest, being at his wit's end, went down to Edo and filed a lawsuit. As a result, without fail as stated above, from the year of the Rat to the year of the Tiger, there was no interference, and we administered the mountain forests and temple grounds as before.
However, in the third year, the aforementioned Izumi-dono and Inaba-dono confiscated the mountain forests and temple grounds. Therefore, both the head priest and parishioners made various appeals saying "If things continue this way, the temple will be destroyed, so please grant us the lands as before," but this was not granted, and in the end the lands were not returned to us, causing us great distress.
