其筋を取失此度右河原開発之上及論
事鉾持村ゟ致出訴候段甚不届之至ニ候
小原村返答書ニハ先年差上候証文通り
鍬入一切不仕候処鉾持村ゟ開発仕候ニ付
相改候由申出候
一 弁才天河原之義上ハ姥ケ懐向白山つるね
より下は険はな向前惣町中用季
場と申出候小原村返答書之趣ハ右河
原之義川ゟ西小原村分ニ而田畑〆六反
七畝九歩御水帳ニ請置候得共不残流失

相違無之ニ付右流跡地六反七畝九歩ハ模
様次第【「可致」を挿入】開発候其余河原之義ハ今般御

間鉾持村町方小原村無差別用事相

その筋道を見失い、この度右の河原開発の上で争論となり、鉾持村から訴え出た件は甚だ不届きな行為である。
小原村の返答書には、先年差し上げた証文の通り、鍬入れは一切行っていないが、鉾持村が開発したので改めて調べた旨申し出ている。
一 弁才天河原については、上は姥ケ懐向白山つるねより、下は険はな向前惣町中用の季場であると申し出ている。小原村返答書の趣旨は、右の河原について川より西は小原村分であり、田畑合計六反七畝九歩を御水帳に請け置いているが、残らず流失した旨申し出ている。

これにより吟味したところ、縄請けの場所に相違ないので、右の流跡地六反七畝九歩は模様次第で開発すること。その余の河原については今般御召し上げ地に申し付けられるので、双方から鍬入れは一切してはならない。ただし河原を利用する件については御用捨していただけるので、鉾持村町方・小原村を区別なく用事を足すことができる。
一 右の高島河原で先年御取り上げ場所の件について、いよいよもってこの上双方鍬入れしてはならない。先年差し出した証文の通り心得て、急度相守らなければならない。

Having lost track of this procedure, the fact that a dispute arose over the development of this riverbed and Hokomochi Village filed a complaint is extremely improper conduct.
In Ohara Village's response document, they state that as per the documentary evidence submitted in previous years, they conducted no cultivation work whatsoever, but investigated the matter because Hokomochi Village had undertaken development.
Item 1: Regarding Benzaiten Kawahara, they claim that the upper area extends from Ubagafutokoro direction to Hakusan Tsurune, and the lower area extends to Kewahana direction, serving as a seasonal area for the use of the entire town community. The content of Ohara Village's response document states that regarding this riverbed, the area west of the river belongs to Ohara Village's portion, with a total of 6 tan 7 se 9 bu of rice fields and dry fields registered in the water registry, though all has been lost to flooding.

As for the remaining riverbed areas, they are hereby designated as confiscated land, so neither party shall conduct any cultivation work. However, regarding the use of the riverbed for necessary purposes, this will be permitted, so both Hokomochi Village townspeople and Ohara Village may use it without discrimination for their needs.
