しかしながら買い戻しについては自力では困難であるとのことで、親類と相談の上、和解により年限を延長いたしました。ところが文久二年戌年に至り、先の新右衛門の跡式養子となったため、買い戻したいとのことで、家屋建築費用等を取り調べて差し遣わしましたが、迷惑で困窮すると申し立て、既に同人の方から御上様へ訴訟を申し上げ、ご厄介をおかけし、その節は厚いご慈悲により、それぞれ仲裁人を仰せ付けられ、ありがたく
双方承知して熟談いたしましたが、その後一向に規定通りの勘定をいたしません。その都度催促いたしましたが今日に至るまで放置しており、どのように金子を工面しても勘定ができないのであれば仕方がない次第につき、なおまた以前の通り金子高に応じて地所を書入として証文を書き替えてくれるよう申し談じましたが、両方とも実現できない旨申し聞かせたため、この度はご理解をいただき、勘定ができないのであれば余儀ない次第につき

However, regarding the buyback, it was difficult to accomplish with their own resources, so after consulting with relatives, they extended the term through mutual agreement. Then in the second year of Bunkyū (1862), when [someone] became the heir-adoptive son of the former Shinemon, they requested to buy back [the property], so we investigated the house construction costs and sent them over. However, they claimed hardship and distress, and eventually filed a lawsuit with the authorities from their side, causing trouble. At that time, through generous compassion, mediators were appointed for each side, and we are grateful.
Both parties reached understanding through thorough discussion, but afterwards they did not make payments according to the agreement at all. We made demands each time, but they have neglected [payment] to this day. Since even if money could be arranged somehow, if accounts cannot be settled, it is an unavoidable situation. We again negotiated for them to rewrite the certificate with the land as collateral according to the amount of money as before, but they said both options were impossible.
