一安永十年平兵衛方と私方と出入御出
訴ニ相成其節双方へ御裁許書委細之
儀御座候而難有頂戴仕所持仕候幷安永
年中丁代役用扣帳ニ伊藤祖右衛門遠藤
久右衛門と記御座候引続遠藤ニ而私別家
勢利町冨士野屋庄兵衛遠藤名乗罷
在候得は湊屋平兵衛方と古キ親類ニハ
可有之候得共別家ニ而ハ無御座候
一満光寺様ゟ御理解被下候様申上候得とも
御咄合被下候而已御理解と申候義は無御座候
一平兵衛願上候義私家之者死去仕候節
私持来之墓所江取置不持致候様
預仕候ニ付墓所之義ヲ別紙ニ認奉差上候

一、安永十年（1781年）に平兵衛方とわたくし方との間で争いが起こり、訴訟となりました。その際、双方に対して裁許書（判決書）が詳細に交付され、ありがたく頂戴し所持しております。また、安永年中（1772〜1781年）の丁代役用控帳（町役人の業務記録帳）には、伊藤祖右衛門・遠藤久右衛門と記されております。引き続き遠藤の名を名乗り、わたくしの別家として勢利町（せりちょう）の富士野屋庄兵衛が遠藤を名乗っております。したがって、湊屋平兵衛方とは古い親類関係にあるかもしれませんが、別家としてはそのような関係にはございません。
一、満光寺様よりご理解（調停・仲介）をいただけるよう申し上げましたところ、お話し合いはしてくださいましたが、ご理解（正式な調停）というものはございませんでした。
一、平兵衛が願い上げました件は、わたくしの家の者が死去いたしました折に、わたくしが持ち来たりました墓所へ取り置かず、持たせないようにとのことで、（墓所を）預けられておりましたことにつき、墓所の件を別紙に認（したた）め、差し上げます。
以上のとおり口上書を差し上げます。

Item: In the 10th year of An'ei (1781), a dispute arose between Heibei's household and my own, which proceeded to litigation. At that time, a detailed written judgment (*saikyosho*) was issued to both parties, which I gratefully received and continue to hold in my possession. Furthermore, in the town official's duty ledger (*chōdai yakuyō hikaechō*) from the An'ei era (1772–1781), the names Itō Soemon and Endō Kyūemon are recorded. In continued succession under the Endō name, my branch household (*bekke*) — Fujinoya Shōbei of Sericho — has been using the Endō name. Therefore, while Minatoya Heibei's household may have an old kinship connection [with the main Endō line], there is no such relationship with [my] branch household.
Item: I requested that Mankōji temple provide mediation (*gorikai*), and while they did engage in discussion, there was no formal mediation as such.
Item: Regarding the matter that Heibei has petitioned about — when members of my household have passed away, [Heibei] had been entrusted with [the grave site] on the condition that [my family's remains] would not be interred in the grave site that I have long maintained and that they would not be allowed to use it. Accordingly, I am submitting a separate document describing the particulars of the grave site.
The foregoing is hereby respectfully submitted as my oral statement in written form.
