一墓所二番通東向之場所平兵衛久右衛門
　両家ニ而一側同所後西向石塔拾六本一側
　私先祖代々持来証拠御座候処嘉永七
　寅年六月私方之石塔江平兵衛方ニ而
　先祖之法名切付手前持分之様自由
　仕候ニ付其断懸合中八月に相成平兵衛
　娘相果申候夫故見合居候内又平兵衛相果
　申候間気之毒ニ存其儘差置候故当平兵衛
　其墓所自分之地所之様ニ心得居候哉と
　奉存候此度平兵衛願之趣久右衛門家内之者
　死去之節右之墓所江取置不持致候様万一
　之義御座候ハヽ御差留被下候様と奉願上候

口上の覚

一、墓所の二番通り東向きの場所は、平兵衛・久右衛門両家で一区画（一側）を共有しており、同所の後ろ（西向き）の石塔十六本の一区画は、わたくしの先祖代々が持ち来たったものであるという証拠がございます。ところが、嘉永七寅年（1854年）六月に、わたくし方の石塔に対して、平兵衛方が先祖の法名を刻み付け、まるで自分の持ち分であるかのように勝手に扱いましたので、その件について掛け合っておりましたところ、八月になって平兵衛の娘が亡くなりました。それゆえ、（話し合いを）見合わせておりますうちに、また平兵衛本人も亡くなりましたので、気の毒に存じてそのままにしておきました。そのため、現在の平兵衛（跡継ぎ）が、その墓所を自分の地所のように心得ているのではないかと存じます。この度、平兵衛が願い上げました趣旨は、久右衛門の家内の者が死去の節に、右の墓所へ取り置かず、持たせないようにしてほしい、万一のことがございましたら差し留めていただきたい、とのお願いでございます。

一、わたくしの先祖の石塔を（平兵衛方が）勝手に扱いましたことにつき、お願い申し上げたいとも思いましたが、お上様（役所・領主）にご面倒をおかけすることを恐れ入り、差し控えておりました。この度、平兵衛方よりお願い上げましたことにつき、墓所の経緯を認め、差し上げます。

Memorandum of Oral Statement

Item: The plot facing east along the second row of the grave site has been shared as one section (*hitokawa*) by both the Heibei and Kyūemon households. The one section of sixteen stone grave markers (*sekitō*) facing west at the rear of that same site has been in the possession of my ancestors from generation to generation, of which I have proof. However, in the sixth month of the 7th year of Kaei, the Year of the Tiger (1854), Heibei's household took the liberty of engraving their ancestors' posthumous Buddhist names (*hōmyō*) on my family's stone markers, treating them as though they were their own property. While I was in the process of remonstrating over this matter, in the eighth month Heibei's daughter passed away. For that reason, I held off [on pursuing the matter], and in the meantime Heibei himself also passed away. Feeling sympathy for their circumstances, I left the situation as it was. As a result, I believe the current Heibei [i.e., the successor] may have come to regard that grave site as his own land. The petition submitted by Heibei on this occasion requests that when members of Kyūemon's household pass away, they not be allowed to inter [their remains] in the said grave site, and that should such a situation arise, [the authorities] be asked to prohibit it.

Item: Although I had wished to file a petition concerning the unauthorized use of my ancestors' stone markers by Heibei's household, I refrained from doing so out of reluctance to trouble the authorities (*kami-sama*). Since Heibei's household has now submitted its own petition on this occasion, I hereby submit this written account of the circumstances surrounding the grave site.
